The poll showed that Ob\/Gyn doctors are more likely than any other type of physician to be sued (85 percent), followed by general surgeons (83 percent) and orthopedists (79 percent).<\/p>\n<p>According to\u00a0<a href=\"http:\/\/www.medscape.com\/features\/slideshow\/malpractice-report-2015\/obgyn#page=1\" target=\"_blank\" rel=\"noopener noreferrer\">the report<\/a>, the most common reasons that doctors get sued, in general, include:<\/p>\n<ul>\n<li>Unexpected injury (36 percent)<\/li>\n<li>Failure to diagnose (22 percent)<\/li>\n<li>Failure to treat (15 percent)<\/li>\n<\/ul>\n<figure class=\"wp-image wp-image--no-caption aligncenter\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter\" src=\"\/wp-content\/uploads\/sites\/1302335\/2016\/02\/Dr20made20a20mistake-1.jpg\" alt=\"\" width=\"853\" height=\"853\" \/><\/figure>\n<p>Most physicians (52 percent), according to the poll, reported being surprised by a lawsuit. Meanwhile, 43 percent of male doctors and 42 percent of female doctors reported that they had suspected they might be sued.<\/p>\n<p>For Ob\/Gyn physicians in particular, the most common reasons for a lawsuit included:<\/p>\n<ul>\n<li>Death of the mother or baby<\/li>\n<li>Failed tubal ligation<\/li>\n<li>Shoulder dystocia<\/li>\n<li>Bowel perforation<\/li>\n<li>Cesarean section (timing or performance)<\/li>\n<\/ul>\n<p>In the majority of cases (32 percent), lawsuits against Ob\/Gyn doctors got settled after deposition. In 15 percent of cases, a verdict was reached after a jury trial.<\/p>\n<p>According to this study, in the majority of cases that go to trial, physicians win\u00a0<a href=\"\/practice-areas\/medical-malpractice\/\">medical malpractice lawsuits<\/a>\u00a0(16 percent) vs. plaintiffs (5 percent). But that doesn\u2019t mean you shouldn\u2019t pursue a lawsuit if you\u2019ve been injured by a medical professional. If you suspect medical negligence was the cause of your injury, you can at least get perspective about your situation by speaking with a lawyer to learn about your options. Medical negligence cases can leave an injured party with long-term unmanageable bills and burdens.
