Understanding Medical Errors, Malpractice, and Gross Negligence

As explained by AllLaw in their article “A Doctor’s Liability for Mistakes: Medical Error, Malpractice, or Gross Negligence?,” not every bad medical outcome is the result of malpractice. While doctors must provide reasonable care, they are not expected to be perfect. Some medical errors are foreseeable complications, while others rise to the level of negligence or even gross negligence. 

Medical malpractice occurs when a healthcare provider breaches the duty of care owed to a patient and that breach causes injury. To prove malpractice, it must be shown that the provider’s actions fell below accepted standards and directly resulted in harm. However, if a complication was a known risk of a procedure—properly disclosed during the informed consent process—it might not constitute malpractice.
