Key Elements You Must Prove in a Medical Malpractice Lawsuit

As explained by AllLaw in their article “Medical Malpractice Claims and Lawsuits,” medical malpractice is essentially a form of negligence, occurring when a health care provider fails to deliver reasonable care, resulting in patient injury. Whether it’s a doctor, nurse, pharmacist, or hospital, careless actions that cause harm may form the basis of a legal claim. 

To pursue a medical malpractice case, four critical elements must be proven: the existence of a duty of care, a breach of that duty, an injury, and a clear causal link between the negligence and the injury. Simply demonstrating negligence isn’t enough—patients must show they were directly harmed as a result of the health care provider’s actions or omissions.
