The Skolnick Weiser Law Firm, LLC, represented plaintiff against the State of Arizona. The State of Arizona negligently permitted an outdated guardrail to remain standing. A driver lost control, striking the guardrail, causing its end to knife into the front passenger compartment, severing the front of the front passenger’s right foot and de-gloving the skin and muscle to above the ankle. Her doctors performed a below the knee amputation. Plaintiff’s expert, who normally testified on Arizona’s behalf, testified that a “break away cable guardrail” should have been installed and this would have avoided the injury. Confidential Settlement
